Dish Network Faces Additional Penalties

(mosimage}TiVo has won an additional $103 million, added to the $104 million it had received earlier, in a claim against Dish Networks.  US District Judge David Folsom found that Dish was violating a permanent injunction by equipping consumer devices with a “workaround” to get past the previous ruling.  Dish had originally infringed upon a patent by TiVo, and must remove the offending features from all but 190,000 of its devices on the market.

This all stems from an initial lawsuit filed by TiVo in 2004, which claimed that Dish had infringed upon their “time warp” patent, allowing viewers to record one program while watching another.  The court found in favor of TiVo, and the ruling has since been upheld on two occasions in appeals court.
