The trial between the Motion Picture Association of America and RealNetworks over the latter’s brief foray into DVD burning technology with RealDVD last fall is being heard this week in San Francisco. RealNetworks contends that its program, which allowed users to rip a copy of a DVD to their hard drives, was meant for a one-time rip to a portable device, which falls in the realm of fair use. The MPAA claims that this violates copyright and promotes consumers to “rent, rip and return.” The National Consumer League supports RealNetworks, because consumers surveyed feel that DVDs should be able to be stored on their computer hard drive, just like CDs. Causing controversy above and beyond the facts of the case, Judge Marylin Patel, who was the judge who shut down Napster in 2001, will not allow press to cover the trial at the request of the MPAA. |
