The news of Napster’s possible demise sent users into a downloading frenzy over the past 18 hours, but now downloading freaks can relax a little. The injunction served to the online file sharing service Napster this past Wednesday was lifted today. Originally scheduled to be shut down tonight at 3am (EST), Napster has been temporarily granted a stay until a formal appeal can be heard by the U.S. Court of appeals for the Ninth Circuit. This appeal is not expected to be until September with Napster’s opening brief due on August 18, the RIAA’s response due September 8 and Napster’s optional reply due on September 12. Napster was granted the say primarily based on the claim that the injunction would have caused the company to "suffer irreparable injury" and would force them to terminate many of their employees. DVD Audio takes another leap forward as Technics has just announced the release of the first DVD-Audio/Video player, the DVD-A10. Using a sampling frequency of 192kHz for two-channel playback, the DVD-Audio player has a frequency response of 96kHz. Refined by Matsushita, the new Digital-to-Analog converter, based on Technics’ MASH technology in the DVD-A10 allows the player to achieve 24-bit quantization. This DAC is combined with a Digital Re-Master Processing circuit that dithers the audio signal to increase the frequency response and dynamic range of conventional CDs.

Napster, the online music service that allows users to swap MP3 audio files for free, was ordered to stop distributing copyrighted songs yesterday by Judge Marilyn Hall Patel. A preliminary injunction was issued against Napster despite attorney David Boise’s attempts to argue that personal copying of music is protected by federal law and that the main purpose of Napster is the promotion of new music.

England’s loudest band, Spinal Tap again needs another drummer. In honor of MGM's Sept 12 release of the band's now infamous rockumentary, "This is Spinal Tap," on DVD and VHS, Listen.com, Rolling Stone and Spinal Tap have launched a search for a new skinsman. Entrants can apply at Listen.com by submitting a 50-word essay on why they should be the new drummer and send in a photo or video of themselves dressed in Spinal Tap garb, preferably spandex and/or leather. The contest will be judged by Spinal Tap's Derek Smalls, Rolling Stone editor David Wild and Listen.com editor Jon Pruett. The winner will receive a trip to Hollywood for the exclusive re-release party at the House of Blues, a meeting with the band, a drum kit, and VHS and DVD copies of the re-mastered movie "This is Spinal Tap".
